User Agreement

Last Updated: September 8, 2026

Welcome to Boldica (the "Service"), accessible at boldica.top, provided by Boldica ("We", "Us", or "Our"). This User Agreement ("Agreement") is a legal agreement between You ("User," "You," or "your") and Boldica governing Your access to and use of the Service. By accessing, browsing, or using the Service in any way, You acknowledge that You have read, understood, and agree to be bound by this Agreement and our Privacy Policy. If You do not agree to any part of this Agreement, You must not access or use the Service.

This Agreement applies to all visitors and users of the Service, regardless of geographic location. Boldica is an educational website that provides accessibility guides and free, browser-based tools designed to support individuals with visual impairments, families, educators, and accessibility professionals.

1. Your Relationship with Boldica

1.1 Service Provider

Boldica is the provider of the Service. The Service is operated and maintained by Boldica. Boldica is an independent entity and is not affiliated with, endorsed by, or sponsored by any third-party products, services, or organizations referenced in our educational content.

1.2 What You Can Expect from Us

We aim to provide useful, accessible educational content about assistive technology and daily routines, as well as free browser-based tools for accessibility practice. We will:

  • Provide educational content written with care and reviewed for accuracy.
  • Develop, improve, and update our tools and content over time.
  • Maintain the Service with reasonable skill and care.
  • Provide the Service free of charge for personal, non-commercial use.

1.3 What We Expect from You

In using the Service, You agree to:

  • Comply with this Agreement and any service-specific terms posted on the Service.
  • Respect the rights of others, including intellectual property and privacy rights.
  • Use the Service only for its intended educational and personal accessibility purposes.
  • Not misuse or abuse the Service or attempt to disrupt its operation.
  • Be at least 13 years of age, or if under 18, have your parent or legal guardian's permission.

2. Age Requirements

You must be at least 13 years old to use the Service. If You are under 18, You represent and warrant that Your parent or legal guardian has reviewed and agreed to this Agreement on Your behalf. Parents or legal guardians are responsible for their children's activity on the Service.

If a child under 13 (or the minimum age required for consent in Your jurisdiction) has provided personal information to Us without parental consent, please contact Us at [email protected] so We can promptly delete such information. Boldica is not directed at children and does not knowingly collect personal information from children.

3. Using the Service

3.1 Account and Access

Boldica does not require accounts or registration to use most features. All interactive tools — Text to Speech, Text Magnifier, Contrast Checker, Color Vision Simulator, Alt Text Helper, and Keyboard Navigation Tester — run entirely in your browser without transmitting data to any server. If We offer account-based features in the future, You are responsible for maintaining the security of Your account credentials and for all activities that occur under Your account.

3.2 Use on Behalf of an Organization

If You are using the Service on behalf of an organization (e.g., as an educator, accessibility professional, or employer representative), You represent and warrant that You have the authority to bind that organization to this Agreement. In such cases, "You" and "Your" include the organization.

3.3 Service-Related Communications

By using the Service, You agree to receive service-related communications, including announcements, updates, and responses to Your inquiries. You may opt out of non-essential communications at any time by using the unsubscribe link in any email or by contacting Us.

3.4 Network and Device Costs

You are responsible for any network, data, cellular, Wi-Fi, or other connectivity charges incurred while accessing and using the Service. Boldica is not responsible for any charges imposed by Your internet service provider, mobile carrier, or other connectivity providers.

3.5 Responsible Use of Tools

The browser-based tools are designed for personal accessibility practice and learning. You agree not to misuse them — for example, by attempting to extract data from other sites, using the tools to automate actions against third-party services, or reverse engineering the tool code for commercial purposes.

4. Content in the Service

4.1 Your Content

Boldica does not claim ownership of any text, data, or content You enter into the tools ("Your Content"). Because all tools process data locally in Your browser, Your Content is never transmitted to, stored on, or controlled by our servers. You retain all rights to Your Content.

If You voluntarily submit feedback, suggestions, or other content through the contact form ("User Submissions"), You grant Boldica a non-exclusive, worldwide, royalty-free, perpetual license to use, modify, summarize, or adapt Your User Submissions to improve the Service, without any obligation or compensation to You. Do not include confidential or sensitive personal information in User Submissions.

4.2 Boldica's Content

The Service's original articles, tool designs, layout, logos, source code, and visual elements are and remain the exclusive property of Boldica and its licensors, protected by applicable copyright, trademark, and other intellectual property laws. The "Boldica" name, logo, and related trademarks may not be used without prior written consent.

You may share links freely and quote brief excerpts with attribution. You may not republish full articles, reproduce the tools, remove or alter proprietary notices, or clone the Service for commercial purposes without prior written consent.

4.3 Third-Party Content

Articles and tools may reference third-party products, services, or websites for educational comparison. Boldica is independent and does not endorse, and is not responsible for, those services. You must obtain any necessary permissions from content owners before using third-party content. Their availability, behavior, and content may change without notice.

4.4 Intellectual Property Infringement Notice

If You believe that any content on the Service infringes Your intellectual property rights, please send a written notice to [email protected] including: (a) a description of the copyrighted work claimed to be infringed; (b) the location of the allegedly infringing material on the Service; (c) Your contact information; and (d) a statement that You have a good-faith belief that the use is not authorized. We will review and respond to valid notices in accordance with applicable law.

5. Software in the Service

5.1 License to Use

Subject to Your compliance with this Agreement, Boldica grants You a personal, non-exclusive, royalty-free, non-transferable, revocable license to access and use the Service's software (including browser-based tools and scripts) for its intended educational purpose.

5.2 Open-Source Components

Some software components used in the Service may be licensed under open-source licenses. Open-source software is governed by its respective license terms, which are available upon request. Nothing in this Agreement limits or restricts Your rights under applicable open-source licenses.

5.3 Restrictions

You agree not to:

  • Copy, modify, distribute, sell, lease, or sublicense the Service's software or tools.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any proprietary software.
  • Remove, alter, or obscure any proprietary notices, copyright marks, or branding.
  • Use automated scripts, bots, crawlers, or scrapers to access or collect data from the Service without permission.

6. Accuracy and Verification

While we write each guide with care, information may become outdated. Boldica provides general educational information about accessible technology and daily routines. Nothing on the Service constitutes medical, legal, financial, or travel advice.

You agree to verify critical details — medication instructions, payment amounts, travel times, accessibility compliance requirements, and safety procedures — through an independent, authoritative source before acting. Automated tool results (such as contrast ratios or simulated color vision) are estimates and should not replace professional accessibility audits.

7. Privacy and Data Responsibility

Because tools process data locally in Your browser, You are responsible for managing the content You enter — especially on shared or public devices. Clear Your browser data if You entered sensitive text while using a tool. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into this Agreement by reference.

Boldica does not require accounts, passwords, or personal details to use the tools. Basic, anonymized analytics may be used to understand which pages are most visited, but this data is not linked to Your identity. We do not sell or rent personal information.

8. Warranties

Except as expressly stated in this Agreement, Boldica provides the Service using reasonable skill and care. However, the Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that:

  • The Service will be uninterrupted, error-free, or free of viruses or other harmful components.
  • The tools will meet Your specific accessibility needs or produce results suitable for compliance certification.
  • All information on the Service is accurate, complete, or current at all times.
  • Any third-party content or services referenced will remain available or function as described.

To the maximum extent permitted by applicable law, Boldica disclaims all implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and course of performance.

9. Disclaimers

The Service provides general educational information and browser-based tools. Boldica does not provide medical, legal, financial, or professional advice through the Service. For decisions affecting health, safety, money, or access to essential services, You should consult a qualified professional or official source.

Tool results — such as contrast ratios, color vision simulations, or alt text suggestions — are automated estimates for educational purposes only. They do not constitute professional accessibility certifications, legal compliance guarantees, or definitive accessibility assessments.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

IN NO EVENT SHALL BOLDICA, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICE.

Our total liability for any claims arising from or relating to this Agreement or the Service shall not exceed the amount You have paid to Boldica for the Service in the twelve (12) months preceding the claim, or US$50, whichever is greater. Since the Service is provided free of charge, this limitation is reasonable.

This limitation of liability does not apply to liability that cannot be limited under applicable law, including liability for fraud, personal injury, gross negligence, or willful misconduct.

11. Indemnification

You agree to defend, indemnify, and hold Boldica and its directors, employees, partners, agents, suppliers, and affiliates harmless from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to attorney's fees) arising from or arising out of:

  • Your use of and access to the Service.
  • Your violation of any provision of this Agreement.
  • Your violation of any third-party right, including intellectual property or privacy rights.
  • Your User Submissions or Your Content.

For business users and organizations, this indemnification includes indemnifying Boldica against third-party legal proceedings (including attorney's fees) arising from Your illegal use of the Service or violation of this Agreement.

12. Actions We May Take

12.1 Content Removal

We may remove or disable access to any content on the Service that violates this Agreement, applicable law, or the rights of others, or that We determine may cause harm or liability. We are not obligated to monitor all content but reserve the right to act when issues are identified.

12.2 Suspension and Termination

We may suspend or terminate Your access to the Service immediately, without prior notice or liability, if:

  • You breach any provision of this Agreement.
  • You engage in repeated or serious violations of the terms.
  • We are required to do so by law or legal process.
  • Your use of the Service creates risk of harm to Boldica or others.

You may stop using the Service at any time. If You have an account, You may request deactivation or deletion by contacting Us at [email protected]. All provisions of this Agreement which by their nature should survive termination — including intellectual property, limitation of liability, indemnification, and governing law — shall survive termination.

13. Dispute Resolution

13.1 Informal Resolution

In the event of any dispute, claim, or controversy arising out of or relating to this Agreement or Your use of the Service ("Dispute"), the parties agree to first attempt to resolve the Dispute informally. The claiming party must send a written notice of the Dispute to the other party at [email protected]. The parties shall attempt in good faith to resolve the Dispute within 60 days of such notice.

13.2 Binding Arbitration

If the Dispute cannot be resolved informally within 60 days, the Dispute shall be finally resolved by binding arbitration administered in accordance with the laws identified in Section 14 (Governing Law and Jurisdiction). The arbitration shall be conducted in the English language. Judgment upon the arbitration award may be entered in any court having jurisdiction. Each party shall bear its own costs, unless otherwise determined by the arbitrator.

13.3 Class Action Waiver

You and Boldica agree that each party may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The parties expressly waive the right to participate in a class action.

13.4 Exception for Injunctive Relief

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or confidential information at any time without first proceeding to informal resolution or arbitration.

14. Governing Law and Jurisdiction

14.1 Governing Law

This Agreement and any dispute arising out of or relating to it or to the Service shall be governed by and construed in accordance with the laws of the United States of America and the State of Delaware, without regard to its conflict of law provisions.

14.2 Jurisdiction and Venue

Subject to the dispute resolution provisions in Section 13, You agree that the exclusive jurisdiction and venue for any legal action, suit, or proceeding arising out of or relating to this Agreement or the Service shall be the state and federal courts located in the State of Delaware, United States of America. You hereby consent to the personal jurisdiction of such courts and waive any objection based on improper venue or forum non conveniens.

14.3 Local Law Exceptions

If You access the Service from outside the United States, You are responsible for compliance with all applicable local laws. Nothing in this Agreement is intended to limit any rights You may have under mandatory provisions of local consumer protection laws that cannot be waived by contract. If any provision of this Agreement is held to be unenforceable in any jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

15. About This Agreement

15.1 Entire Agreement

This Agreement, together with our Privacy Policy and any service-specific terms posted on the Service, constitutes the entire agreement between You and Boldica regarding the use of the Service. It supersedes and replaces any prior agreements, understandings, or representations, whether oral or written, between the parties regarding the subject matter herein.

15.2 No Third-Party Rights

This Agreement does not create any rights for any third party. No person or entity who is not a party to this Agreement shall have any right to enforce any of its provisions.

15.3 Updates to This Agreement

We may update or modify this Agreement from time to time at our sole discretion to reflect changes in our Service, business, legal or regulatory requirements, or to prevent abuse. When We do, We will:

  • Post the updated Agreement on this page.
  • Update the "Last Updated" date at the top of this page.
  • Provide notice of material changes at least 30 days before they take effect.

Your continued use of the Service after any changes to this Agreement constitutes Your acceptance of the revised terms. If You do not agree with the updated Agreement, You must discontinue using the Service.

15.4 Conflict Resolution

If there is any conflict between this Agreement and any service-specific terms posted on the Service, the service-specific terms shall prevail with respect to the specific service. If there is a conflict between this Agreement and our Privacy Policy, the Privacy Policy shall prevail with respect to privacy-related matters.

15.5 Waiver and Severability

No failure or delay by Boldica in exercising any right under this Agreement shall constitute a waiver of that right. If any provision of this Agreement is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
